This Cancellation Policy forms an integral part of the terms and conditions governing all Consultancy and Visa Application Services provided by Filii Magna Limited (“Filii Magna” or “the Company”). It outlines the conditions under which a Client may cancel services previously engaged, together with the consequences, applicable deductions, and administrative charges.

By engaging Filii Magna’s services, the Client acknowledges and agrees to be bound by the provisions of this Policy.

1. Right to Cancel

1.1     A Client may, at their discretion, cancel any Consultancy or Visa Application Service provided by Filii Magna, subject to the terms herein.

1.2 All cancellation requests must be submitted in writing and duly acknowledged by Filii Magna before such cancellation shall be deemed effective.

1.3    Oral or verbal notices of cancellation shall not be recognized unless subsequently confirmed in writing and acknowledged by the Company.

2. Cancellation Prior to Commencement of Service

2.1    Where a Client cancels a Consultancy or Visa Application Service before commencement of processing, and no visa fees have been paid to the receiving consulate or embassy, the Client shall be eligible for a refund of the Consultancy Fees paid, less a five percent (5%) administrative charge, in line with the Refund Policy.

2.2   Such cancellations must be communicated within twenty-four (24) hours of payment to qualify for a full refund (less administrative charge).

3. Cancellation After Commencement of Application

3.1    Where Filii Magna has commenced processing a visa or related application and the Client elects to cancel after two (2) working days, the following shall apply:

• The Client shall forfeit the right to any cash refund; and
• The Client may transfer the value of the current application to another visa application for the same applicant, subject to a twenty-five percent (25%) administrative deduction on the current application value.

3.2    Upon such transfer, an additional twenty-five percent (25%) of the Consultancy Fee shall be payable for the new application being considered.

4. Cancellation at Advanced Stages of Application

4.1    Where the application process has reached beyond fifty percent (50%) completion, and the Client requests cancellation, the following terms shall apply:

• The Client shall forfeit entitlement to a cash refund; and
• The application may only be transferred to another process for the same applicant, subject to a minimum deduction of fifty percent (50%) of the Consultancy Fee and applicable administrative charges.

4.2       Determination of completion percentage shall be made solely by Filii Magna, based on internal documentation and the Client Officer’s report.

5. Cancellation Close to Appointment Date

5.1     Where the visa application process has reached beyond seventy percent (70%) completion and the Client requests to cancel or postpone the application within one (1) week of the scheduled appointment date, a minimum of sixty-five percent (65%) of the Consultancy Fee shall be deemed earned and non-refundable.

5.2     Any transferable credit note issued under such circumstance shall be less applicable administrative deductions.

6. Cancellation After Five (5) Working Days

6.1     Any cancellation requested after five (5) working days from commencement of the visa process—whether or not visa fees have been paid—shall be subject to the same terms applicable to Clause 5 above.

6.2    Where visa fees have not been paid to the consulate, such fees may be refundable less a ten percent (10%) administrative charge, in accordance with the Refund Policy.

7. Administrative Deductions

7.1    Filii Magna shall be entitled to deduct the applicable administrative and processing charges from all amounts due to Clients upon cancellation, as stipulated under this Policy or any related Refund Policy.

7.2   The Company reserves the right to adjust administrative percentages periodically in line with operational costs and prevailing business conditions.

8. Effect of Cancellation

8.1        Upon acknowledgement of a valid cancellation request:

• All ongoing processing activities in respect of the Client’s application shall cease immediately; and
• Filii Magna shall prepare a reconciliation of all payments, deductions, and any transferable value due to the Client.

8.2    Any outstanding obligations or balances owed by the Client at the date of cancellation shall become immediately due and payable.

9. Processing Timeline

9.1     All approved cancellations and applicable refunds or transfers shall be processed within ten (10) to fifteen (15) working days from the date of written acknowledgment by Filii Magna.

9.2    All transfers or credit notes issued shall clearly state the residual value and the applicable validity period for future use.

10. General Provisions

10.1    The Company reserves the exclusive right to determine the stage of any application, the value of work completed, and the appropriate deductions to be applied upon cancellation.

10.2    This Policy shall be read in conjunction with Filii Magna’s Refund Policy and Terms of Engagement.

10.3   The Company may revise or amend this Policy without prior notice, and such revisions shall take immediate effect upon publication or communication to Clients.

10.4   Nothing in this Policy shall prejudice any right of Filii Magna under applicable law or contract.
